GEORGIA
Georgia Immunization Requirements
Authority: Education, Part III, Health, Ga. Code Ann. 20-2-771. Rules of
Department of Human
Resources Public Health, Ga. Comp. R. & Regs.§ 290-5-4-. 01 to .09.
General Rule: No child shall be admitted to or attend any school or facility
in this state unless
the child shall first have submitted a certificate of immunization to the
responsible official of the
school or facility. - GCA § 20-2-771 (b). The Department of Human Resources
shall promulgate
rules and regulations specifying those diseases against which immunization
is required and the
standards for such immunizations. GCA § 20-2-771 (c).
Exceptions:
1) There is a 30 day waiver, extendable to 90, granted after request to a
school official, in order
to allow the parents time to immunize the child. GCA § 20-2-771 (b).
2) If a child has a physical disability that would make immunization
undesirable, the child may
be granted an exemption certificate until the problem is relieved. GCA §
20-2-771 (d).
3) A child may be exempted on religious grounds if a parent furnishes an
affidavit swearing that
the immunization required conflicts with the religious beliefs of the
parent. The immunization
may be required in cases when such disease is in epidemic stages. GCA §
20-2-771(e). Religious
belief in divine healing through faith not to excuse refusal to have
children vaccinated. Son v.
State, 84 Ga. App. 259, 65 S.E. 2d 848 (1951).
Definitions:
Immunization - the presumptive presence in the body of an immunized person
of sufficient
protective antibodies or of cellular immunity, as a result of previous
infection or introduction of
specific antigenic agents, or a presumptive state of being so conditioned by
previous experience
with a particular disease so as to provide an immediate and protective
response upon exposure to
specific infectious agents of that disease. GCRR 290-5@-01(a).
Facility - any public or private daycare center or nursery intended for the
care, supervision, or
instruction of children.' GCA § 20-2-771 (a)(2).
Responsible Official - a county school superintendent, a school principal,
or a chief operating
officer of a school or facility.' GCA § 20-2-771 (a)(3). School--any public
or private educational
program or institution instructing children at any level or levels, K-12, or
children of ages five
through 19 if grade divisions are not used.' GCA § 20-2-771 (a)(4).
Designated Diseases: Diphtheria, pertussis, tetanus, poliomyelitis, measles,
rubella, mumps and
haemophilus Influenzae type b in child care facilities only. GCRR
290-5-4-.02(l).
Penalty: Any responsible official or parent permitting a child to remain in
school in violation of
the immunization rules shall be guilty of a misdemeanor and shall be punished
with a fine of not
over $100 or imprisonment of not more than 12 months. GCA § 20-2-771 (h).
HAWAII
Hawaii Immunization Requirements
Authority: Education. Schools and Attendance. Generally, Haw. Rev. Stat. §
298-41 to 52.
General Rule: "No child shall attend any school in the State unless
such child presents to the
appropriate school official certification from a licensed physician stating
that the child has
received immunizations against communicable diseases as required by the
department of
health." HRS § 298-42(a) Additionally, "no child shall be admitted
to any school for the first
time" without presenting a certificate that "the child has
received a tuberculin test or x-ray" and
is free from it in its communicable form. HRS § 298-42(b)
Exceptions: There are two major exemptions, HRT § 298-44:
1) If a doctor certifies that "the physical condition of the child is
such that immunizations would
endanger his life or health.'
2) If the parent or guardian objects "in writing on the grounds that
such immunization conflicts
with his bona fide religious tenets and practices. Upon showing the
appropriate school official
satisfactory evidence of such exemption, no certificate or other evidence of
immunization shall
be required for entry into school.
Provisional Entrance: A child may enter school provisionally upon showing
proof that the
process of immunization is proceeding. Certificate of completion of required
immunizations
must be given no later than three months after the child first entered
school. HRT § 298-43.
Epidemic: No exemptions will be recognized if the department of health
suspects a danger of
epidemic. Quarantine shall be a legal alternative to immunization. HRS §
298-45.
Definitions: School - Any day care center, child care facility, headstart
program, preschool,
kindergarten, elementary, or secondary school, public or private, including
and special school for
children in the State." HRS § 298-41.
Certificate: The department of education provides health certificate forms
for immunization,
which when signed by a doctor are acceptable. HRS § 298-48.
IDAHO
Idaho Immunization Requirements
LEGAL AUTHORITY. (IDAPA 16.02.15.000)
The Idaho Legislature has granted to the Board of Health and Welfare, in
cooperation with the
State Board of Education and the Idaho School Boards Association, the
authority to adopt rules
for the administration and enforcement of an immunization program for Idaho
school children,
pursuant to Section 39-4801, Idaho Code. Effective Date: (1-25-79)
TITLE AND SCOPE.
01. Title. These rules are to be cited as Idaho Department of Health and
Welfare Rules, IDAPA
16, Title 02, Chapter 15, "Immunization Requirements for Idaho School
Children." Effective
Date: (1-25-79)
02. Scope. These rules contain the legal requirements for the administration
of an immunization
program for children enrolled in grades preschool, kindergarten through
twelve (12) of any Idaho
public, private, or parochial school. Effective Date: (10-13-92)
IMMUNIZATION PROGRAM.
The immunizations listed in Subsections 100.01 through 100.04 are required
of children who are
to attend preschool, kindergarten through grade twelve (12) in any Idaho
public, private, or
parochial school and must be administered in the manner and in accordance
with medical
standards recognized by the Idaho Board of Medicine and with the
"Immunization
Recommendations" available from the Bureau of Communicable Disease
Prevention within the
Department. Effective Date: (10-13-92)
01. Measles, Rubella, and Mumps. One (1) dose of Measles, Rubella and Mumps
vaccine
administered to the child on or after his first (1st) birthday; and
Effective Date: (10-13-92)
02. Diphtheria, Tetanus, Pertussis (DTP), Diphtheria, Tetanus (DT Pediatric)
and/or Tetanus,
Diphtheria (Td). Any combination of four (4) or more doses of DTP
(Diphtheria, Tetanus,
Pertussis), DT (Diphtheria, Tetanus) and/or Td (Tetanus, Diphtheria)
vaccine, unless fewer
doses are medically recommended (see Subsection 110.01); and Effective Date:

03. Polio. Three (3) or more doses of Polio vaccine, unless fewer doses are
medically
recommended (see Subsection 110.01). Effective Date: (12-31-91)
04. Hepatitis B. Three (3) doses of Hepatitis B vaccine administered to
children born after
November 22, 1991, unless fewer doses are medically recommended (see
Subsection 110.01).

102. EVIDENCE OF IMMUNIZATION STATUS.
01. Immunization Certification Statement. Within the deadlines established
in Section 101, a
legal parent, custodian, or guardian of each child must present to school
authorities an
immunization certification statement signed by a physician or a physician's
representative stating
the type, number and dates of immunizations received. Effective Date:

02. Schedule of Intended Immunizations. A statement by a legal parent,
custodian or guardian of
any child who is not immunized, excepted or exempted, and who is in the
process of receiving,
or has been scheduled to receive the required immunizations, must be in the
possession of
school authorities at the time of first admission and before attendance on a
form provided by the
Department or one substantially similar, to include the following
information: Effective Date:

a. Name and age of child; and Effective Date: (7-9-90)
b. School attending and grade in which enrolled; and Effective Date:
(7-9-90)
c. Type, number and dates of immunizations to be administered; and Effective

d. Signature of the legal parent, custodian or guardian providing the information;
and Effective

e. Signature of a physician or physician's representative. Effective Date:
(7-9-90)
03. Children Admitted to School and Failing to Continue the Schedule of
Intended
Immunizations. A child who does not receive the required immunizations as
scheduled in
Subsection 102.02, shall be excluded by school authorities until
documentation of the
administration of the required immunization(s) is provided to school
authorities by the child's
legal parent, custodian, or guardian. Effective Date: (10-13-92)
105. EXCEPTIONS TO IMMUNIZATION REQUIREMENT.
A child who meets one (1) or more of the following conditions, if supporting
documentation is
in the possession of school authorities at the time of first admission and before
attendance, will
not be required to undergo the required immunizations: Effective Date:

01. Laboratory Proof. Laboratory proof of immunity to any of the seven (7)
childhood diseases
listed in Section 100; or Effective Date: (10-13-92)
02. Disease Diagnosis. Signed statement of a licensed physician stating
child had Measles or
Mumps disease diagnosed by the MD upon personal examination. Effective Date:
(1-25-79)
110. EXEMPTIONS TO IMMUNIZATION REQUIREMENT.
A child who meets one (1) or both of the following conditions, if supporting
documentation
from the legal parent, custodian or guardian is in the possession of school
authorities at the time
of first admission and before attendance, will not be required to undergo
the required
immunization(s) for which the condition(s) exists: Effective Date:

01. Life- or Health-Endangering Circumstances. A signed statement of a
licensed physician that
the child's life or health would be endangered if any or all of the required
immunizations are
administered; or Effective Date: (8-15-79)
02. Religious or Other Objections. A signed statement of the legal parent,
custodian or guardian
on a form provided by the Department or on one containing substantially
similar information, to
include the following information: Effective Date: (10-13-92)
a. Name of child; and Effective Date: (1-25-79)
b. A statement of objection on religious or other grounds. Effective Date:
(1-25-79)
150. ENFORCEMENT OF IMMUNIZATION REQUIREMENT.
01. Noncompliance. Any child not in compliance with this chapter upon first
admission in
preschool, kindergarten through grade twelve (12) in any Idaho public,
private or parochial
school shall be denied attendance by school authorities Effective Date:

02. Length of Exclusion. Any child denied attendance in accordance with
Subsection 150.01
shall not be allowed to attend any Idaho public, private or parochial school
until they are in
compliance with the requirements of this chapter. Effective Date: (10-13-92)
200. REPORTS BY SCHOOL AUTHORITIES.
01. Responsibility and Timeliness. School authorities must transmit copies
of a report of each
school's immunization status, by grade, to the State Department of Education
on or before the
first (1st) day of November of each year. Effective Date: (10-13-92)
02. Form and Content of Report. On a form provided by the Department, the
following
information by school and by grade must be reported: Effective Date:

a. School and enrollment identification information including; Effective
Date: (10-13-92)
i. Inclusive dates of reporting period; Effective Date: (10-13-92)
ii. Name/address of school, school district/county in which located;
Effective Date: (10-13-92)
iii. Grade reported/total children enrolled in each grade; and Effective
Date: (10-13-92)
iv. Signature and title of the person completing the report form. Effective
Date: (10-13-92)
b. Total children enrolled and attending school in each grade who: Effective
Date: (10-13-92)
i. Meet all of the required immunizations listed in Section 100; and
Effective Date: (12-31-91)
ii. Do not meet all of the required number of immunizations by specific
immunization types for
the following reasons: Effective Date: (8-15-79)
(1) They do not meet the immunization requirement but are in the process of
receiving the
required immunizations; or Effective Date: (10-13-92)
(2) They claimed exemption to the required immunizations as allowed in
Section 110. Effective
Date: (10-13-92)
ILLINOIS
Illinois Immunization Requirements
Authority: the School Code, Ill. Ann. Stat. ch. 122 para. 27-8.1
(Smith-Hurd). IAS 111 1/2 &
22.11 IAS 122 && 26-1 and 26-10.
General Rule: "In compliance with rules and regulations which the
Department of Public Health
shall promulgate, and except as hereinafter provided, all children in
Illinois shall have a health
examination as follows: Within one year prior to entering Kindergarten or
the first grade of any
public, private or parochial school; prior to entrance into any public, private
or parochial nursery
school; and, irrespective of grade, immediately prior or upon entrance into
any public, private or
parochial school, or nursery school, each child shall present proof of
having been examined in
accordance with this Section and the rules and regulations promulgated
hereunder." IAS 122 &
27-8.1(1).
"Every child shall, at or about the same time as he receives a health
examination as required by
subsection (1) of this Section, present to the local school, proof of having
received such
immunizations against preventable communicable diseases as the Department of
Public Health
shall require by rules and regulations promulgated pursuant to this Section
and "An Act in
relation to the prevention of certain communicable diseases", approved
July 5, 1967, as
amended" IAS 122 & 27-8.1(3).
"It is declared to be the public policy of this State that all children
shall be protected, as soon
after birth as medically indicated, by the appropriate vaccines and
immunizing procedures to
prevent communicable diseases which are or which may in the future become
preventable by
immunization." IAS 111 1/2 & 22.11.
Exceptions: IAS 122 & 27-8.1(8).
1) "Children whose parents or legal guardians object to health
examinations or any part thereof,
or to immunizations, on religious grounds shall not be required to submit
their children or wards
to health examinations or immunizations if such parents or legal guardians
present to the
appropriate local school authority a signed statement of objection,
detailing the grounds for such
objection."
2) "If the physical condition of the child is such that any one or more
of the immunizing agents
should not be administered, the examining physician responsible for the
performance of the
health examination shall endorse such fact upon the health examination
form."
Provisional: "If a child does not submit proof of having had either the
health examination or the
immunization as required, then the child shall be examined or receive the
immunization, as the
case may be, and present proof by October 15 of the current school year;
provided, if for medical
reasons one or more of the required immunizations must be given after
October 15 of the current
school year, then the child shall present, by October 15, a schedule for the
administration of the
immunizations and a statement of the medical reasons causing the delay. If a
child does not
comply by October 15 of the current school year with the requirements of
this subsection, then
the local school authority shall exclude that child from school until such
time as the child
presents proof of having had the health examination as required, and
presents proof of having
received those required immunizations which are medically possible to
receive immediately.
During a child's exclusion from school for noncompliance with this
subsection, the child's
parents or legal guardian shall be considered in violations of Section 26-1
and subject to any
penalty imposed by Section 26-10. IAS 122 & 27-8.1(5)
INDIANA
Indiana Immunization Requirements
Authority: Education--Pupils, Chapter 7 Health Measures, Ind. Code Ann. §§
20-8.1-7-7.1 to
11. Indiana State Department of Health, Ind. Admin. Code tit. 410, r, 1-1-1
to 1-1-4.
General Rule: The governing body of each school corporation shall require
the parents of a child
who has enrolled in a school to furnish no later than the first day of
school a written statement of
the child's immunization, accompanied by the physician's certificates or
other documentation's,
unless a written statement of this nature is on file with the corporation.
ICA §§ 20-8.1-7-10.1.(a)
Exceptions: There are 3 exceptions:
1) "...... no school child shall be required to undergo any testing,
examination, immunization or
treatment required under this chapter when his parent objects" in a
writing that is signed "and
delivered to the child's teacher or to the individual who might order a
test, exam, immunization
or treatment absent the objection." ICA &20-8.1-7.2.
2) The school gives the parents of the child a waiver, which may not exceed
a period of 20 days.
ICA &20-8.1-7-10.1. ( c )(1).
3) The health department or a doctor "determines that the child's
immunization schedule has
been delayed due to extreme circumstances" and "will not be
completed before the first day of
school." "In this case, the parent," "shall furnish a
written statement and a time schedule,
approved by the health department" or doctor, for the completion of the
immunizations. ICA &
20-8.1-7-10.1. ( c )(2).
Certificate: "The physician who administers the required vaccines to a
child shall give a
certificate or other documentation of the immunizations to the person who
presented the child
for immunization. This certificate or other documentation shall be presented
on required to the
local health department or its authorized representative." ICA &
20-8.1-7-9.6(b).
Designated Diseases: Diphtheria, whooping cough, tetanus, measles, rubella,
poliomyelitis,
mumps. ICA &20-8.1-7-9.5
Strategy: The first exemption is extremely broad and allows a parent to
object to any one or all
immunizations simply by filing a signed statement with the governing body of
the school.
IOWA
Iowa Immunization Requirements
Authority: Public Health, Communicable and Reportable Diseases, Iowa Code
Ann. g 139.9.
Public Health, Chapter 7, Immunization of Persons Attending Elementary or
Secondary Schools
or Licensed Child-Care Centers, Iowa Admin. Code r. 641-7.1(139) to 7.
10(139).
General Rule: "No person shall be enrolled in any Licensed day care
center, elementary or
secondary school in Iowa without evidence of adequate immunization
against" the designated
diseases. ICA 139.9.2. Persons included. The immunization requirements
specified elsewhere in
these rules apply to all persons enrolled or attempting to enroll in a
licensed child-care center or
a public or nonpublic elementary of secondary school in Iowa. L4C
641-7.2(139).
Exceptions: There are two major exceptions ICA 139.9.4.:
1) "A statement signed by a doctor," "in which it is stated
that," "the immunizations required
would be injurious to the health and well-being of the applicant."
2) 'An affidavit signed by the applicant or, if 1 minor, by a legally
authorized representative,
stating that the immunization conflicts with the tenets and practice of a
recognized religious
denomination of which the applicant is an adherent or member.
Provisional Enrollment: "A person may be provisionally enrolled,'
"if the person has begun the
required immunizations" and will receive the necessary ones 'as rapidly
as medically feasible."
ICA 139.9.5.
Epidemic: Religious exemption does not apply in times of emergency/epidemic.
ICA 139.9.4(b).
Definitions LIC 641-7.1(139):
Elementary School - "means kindergarten if provided, and grades 1
through 8 or grades 1
through 6 when grades 7 and 8 are included in a secondary school."
Secondary School - "means (a) a junior high school comprising grades 7,
8 and 9, and a senior
high school; (b) a combined junior-senior high school comprising grades 7
through 12; (c) a
junior high school comprising grades 7 and 8 and a high school comprising
grades 9 through 12;
(d) a high school comprising grades 9 through 12."
Certificate: "Applicants, or their parents or guardians, shall submit a
valid Iowa department of
public health certificate of immunizations to the admitting official of the
school or licensed
childcare center in which the applicant wishes to enroll. To be valid, the
certificate shall be
signed by a doctor, or a physician's assistant, or a registered nurse, or a
school nurse, or an
official of a local health department LIC 641-7,5(139)(1).
Designated Diseases: Diphtheria, pertussis, tetanus, poliomyelitis, rubeola,
and rubella. ICA
139.9.1.
Responsibility of Parents: "Every parent or legal guardian shall assure
that the person's minor
children residing in the state have been adequately immunized against' the
designated diseases.
